By accessing or using Open Folio Pro ("the Service", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
Open Folio Pro is a portfolio tracking and record-keeping tool only. Nothing on this platform constitutes financial product advice, investment advice, tax advice, or any other regulated advice within the meaning of the Corporations Act 2001 (Cth) or any other Australian law.
All information displayed — including portfolio values, tax estimates, dividend forecasts, and P&L figures — is for informational and organisational purposes only. It is based on data you provide and third-party price feeds that may be delayed, inaccurate, or unavailable.
You should consult a licensed financial adviser, accountant, or tax professional before making any investment or tax decision. Open Folio Pro is not licensed to provide financial services under the Corporations Act 2001.
CGT calculations, tax estimates, and franking credit summaries shown in the Service are approximations based on the trade data you have entered. They are not a substitute for professional tax advice or a formal tax return. Open Folio Pro makes no representation that these figures are accurate, complete, or consistent with ATO requirements. You are solely responsible for your tax obligations.
You are responsible for maintaining the security of your account credentials. You must not share your account with others or permit unauthorised access.
All trade records, holdings, and financial data you enter are owned by you. We do not sell your data to third parties. See our Privacy Policy for full details.
If you connect a broker or exchange account via API key, you are solely responsible for ensuring that key has appropriate permissions (read-only). We strongly recommend you create API keys with no withdrawal or trading permissions.
API keys are stored in our database. While we apply access controls (row-level security), keys are not end-to-end encrypted at rest. You may delete your connection and revoke your API key at any time via the platform that issued it.
The Service uses third-party APIs including Yahoo Finance and CoinGecko for price data, and Supabase for data storage. We are not responsible for the accuracy, availability, or continuity of these services. Dividend forecasts are generated from historical data and are not guaranteed.
To the maximum extent permitted by Australian law, Open Folio Pro and its operators are not liable for any loss or damage — including financial loss, lost profits, or data loss — arising from your use of the Service, reliance on information displayed, or inaccuracies in imported data or price feeds.
Where liability cannot be excluded under the Australian Consumer Law, our liability is limited to re-supplying the relevant service.
You must not use the Service to: violate any law; attempt to gain unauthorised access to our systems; scrape or reverse-engineer the platform; or upload data that infringes third-party rights.
Paid subscriptions are billed via Stripe. Subscription fees are non-refundable except where required by the Australian Consumer Law. We reserve the right to change pricing with 30 days' notice. You may cancel at any time; cancellation takes effect at the end of the current billing period.
We may suspend or terminate your account if you breach these terms. You may delete your account at any time, which will permanently remove your data from our systems.
We may update these terms from time to time. Continued use of the Service after changes are posted constitutes acceptance. Material changes will be notified by email.
These terms are governed by the laws of the Australian Capital Territory, Australia. Any disputes are subject to the exclusive jurisdiction of the courts of the ACT.
